Website Terms and Conditions of Use

  1. Your acceptance of these terms. Shibleyrighton.com (the “Site”) is maintained by Shibley Righton LLP (“Shibley Righton”). The Site contains information, data, articles, publications, and other materials accessible to the general public (the “Content”). Your use of the Site and Content is subject to the terms and conditions set forth below. By using the Site, you agree that you accept and will abide by these terms and conditions, and Privacy Policy. If you do not accept these terms and conditions, or the Privacy Policy, do not use the Site.   
     

  2. Not legal advice. The Content is made available on the Site free of charge strictly for informational purposes only. Shibley Righton is committed to updating the Content, but the Content may no longer be valid at any time for a variety of reasons, including but not limited to changes to the applicable law. None of the Content is intended to be taken as legal advice. The Content should not be relied upon as accurate, timely, or fit for any particular purpose. You should not rely on, or take or fail to take any action based on the Content. If you wish to obtain legal advice on any matters, including the Content, please feel free to contact Shibley Righton for a consultation. Contacting us does not create a confidential lawyer-client relationship in any way. Please do not send any confidential information to us until such time as a lawyer-client relationship has been established.
     

  3. Not confidential. Your use of the Site, including any communications you may make with Shibley Righton through the Site, does not mean the firm is acting on your behalf. No one becomes a client of Shibley Righton unless and until it is determined that there is no conflict of interest if you were to become a client, and formal retainer agreement is signed in accordance with Shibley Righton’s policies. Unless you are an existing client of Shibley Righton, no communication will be treated as confidential at any time. Do not send Shibley Righton any information or documents until a formal lawyer-client relationship has been established through an interview with a lawyer and you get authorization in the form of an engagement letter from Shibley Righton LLP or otherwise formally engage Shibley Righton LLP. You acknowledge there is a risk that any information or documents sent prior to your receipt of an engagement letter cannot be held in confidence or treated as secrets or protected information.
     

  4. Copyright. All Content displayed on the Site is copyrighted by Shibley Righton, or the exclusive intellectual property of those so designated on the Site. None of the Content may be reproduced in any form for commercial purposes without the express written consent of Shibley Righton. Anyone seeking to reproduce the Content or link this Site to any external website shall do so only with the express written consent of Shibley Righton by email at admin@shibleyrighton.com.  
     

  5. Limited license. You agree that you will not use the Site for any unlawful purposes. Subject to these terms, you are hereby granted a limited, non-transferable and non-exclusive licence to access, view and use the Site for your personal, non-commercial use, with the right to download, store and print single copies of items comprising the Content, provided that the Content is not altered in any manner without the written consent of Shibley Righton, and you maintain all copyright and other notices contained in such Content.
     

  6. Third party links. For your convenience and information only, the Site may provide links to third party websites. You acknowledge and agree you assume all risks and liability in accessing such third-party websites, including risks of any if your personally identifiable information being collected without your consent and damages caused by computer viruses, Trojan horses or other destructive/disruptive code which may be downloaded from such linked websites. Shibley Righton has not verified the nature or accuracy of the information contained on such third-party websites and assumes no liability for any damages you may suffer from visiting such third-party websites.
     

  7. Privacy policy. Any of personal or identifying information that you may provide to us will be subject to our Privacy Policy.
     

  8. Limitation of liability. Shibley Righton expressly disclaims all warranties and conditions, including any implied warranties of security, accuracy, reliability, accessibility, merchantability, fitness for a particular purpose, title, quiet enjoyment or non-infringement in respect to the Site and Content, to the fullest extent permissible under applicable law. By your access and continued use of the Site, you acknowledge and agree that you do so entirely at your own risk and liability.
     

  9. Indemnity. In no event shall any lawyers, employees, consultants, or agents of Shibley Righton (the “Shibley Righton Releasees”) be liable to you for damages of any kind, including without limitation, any direct, special, indirect, punitive, incidental or consequential damages including, without limitation, any loss or damages in the nature of or relating to lost business, lost savings, lost data and/or lost profits arising from your use of, reliance upon, or inability to use the Site or the Content. By your access and continued use of the Site, you agree to indemnify and hold harmless the Shibley Righton Releasees from and against any claims, losses, judgments, damages, costs and expenses (including without limitation, reasonable legal fees) incurred by any of them due to or resulting from your use of the Site or Content, and from any claims brought by third parties arising out of your use of Site or Content.
